Melissa A. Provost practices insurance coverage litigation, employment and labor law and professional liability counseling. She represents insurance companies on coverage and bad faith matters involving property, commercial casualty, general liability, professional liability, directors and officers’ liability, and other specialized coverages. Melissa also litigates matters arising in the workplace, including defense of a variety of discrimination claims, employment contracts and non-compete agreements.

Professional History

Prior to joining the firm, Melissa clerked for the Honorable Mahlon L. Fast of the Superior Court of New Jersey, Essex County, and was the Notes and Comments Editor of the Seton Hall Constitutional Law Journal.

Representative Matters

Successfully tried an insurance coverage case in New Jersey state court.

Defended an ethnicity and disability discrimination claim brought by a professor against a New Jersey college.

Performed an independent internal investigation into an employment matter for a major New Jersey university.

Defended and successfully resolved a lawsuit against a real estate attorney accused of legal malpractice in connection with an allegedly fraudulent closing.

Noteworthy Decisions

Hampton Medical Group v. Princeton Insurance Company, 366 N.J. Super. 165 (App. Div. 2004). Court found that a professional liability policy did not provide coverage for claims of fraudulent billing.
