In a case in which Saiber was specially engaged by the New Jersey Office of the Attorney General, attorneys Sean R. Kelly and John F. Finnegan III successfully defended the State’s Division of Consumer Affairs in a two-week jury trial in the Superior Court of New Jersey, Law Division, Essex County.
The plaintiff asserted race discrimination claims by way of a three-count Complaint alleging a hostile work environment, failure-to-promote, and violation of due process and equal protection rights under the State Constitution. With respect to her failure-to-promote race discrimination claim, Plaintiff cited three instances in which she was not promoted to open positions within the DCA on the basis of her African-American race.
At the close of the plaintiff’s case, Mr. Finnegan successfully argued for involuntary dismissal of the plaintiff’s hostile work environment and State Constitutional claims, as well as one of the three asserted instances of failure-to-promote.
Thereafter, the jury returned a no-cause verdict on each of the two remaining instances of failure-to-promote.
