Pennsylvania Supreme Court Rules Skill Game Devices Are Slot MachinesOn June 15, 2026, the Pennsylvania Supreme Court issued a landmark decision in In Re: Three Pennsylvania Skill Amusement Devices, et al. (No. 50 MAP 2024) and POM of Pennsylvania, LLC v. Commonwealth of Pennsylvania, Department of Revenue, et al. (No. 2 EAP 2024), reversing two Pennsylvania Commonwealth Court decisions and holding that “skill game” devices are “slot machines” under the Pennsylvania Race Horse Development and Gaming Act, 4 Pa.C.S. §§ 1101-1904 (the “Gaming Act”). The opinion, authored by Justice Wecht and joined by Chief Justice Todd and Justice McCaffery, describes the Commonwealth Court’s prior interpretation of governing statutes and their application to “skill game” devices as “deeply flawed.” The Court stayed its order for 120 days, providing the General Assembly with time to develop legislation which addresses the estimated 70,000 skill game devices currently operating in the Commonwealth. -

The Saiber Construction Law Column: April 2026To assert a claim for fraud in New Jersey, a plaintiff must show (1) a material misrepresentation of a presently existing or past fact, (2) knowledge or belief by the defendant of its falsity, (3) an intention that the other party rely on it, (4) reasonable reliance on it by the other party, and (5) resulting damages. On March 20, 2026, the Supreme Court of Alabama overturned a $100,000 jury award entered against a construction company sued for fraud after determining the evidence presented at the trial wasinsufficient to establish fraud. -

Navigating New Jersey’s Enhanced Flood Disclosure RequirementsEffective on March 20, 2024, a newly enacted New Jersey statute expanded the obligations of sellers and landlords regarding flood risk transparency. These requirements apply to both residential and commercial transactions and must be satisfied prior to contract execution. For real estate brokers and agents, compliance is no longer a matter of best practice, but a legal requirement that, if not followed, may result in contract rescission and potential liability. -

The Saiber Construction Law Column: February 2026An arbitration clause is a contractual provision that requires parties to resolve certain disputes through arbitration rather than in court. New Jersey has a very strong public policy which favors arbitration as a quick, cost-effective way of resolving disputes. However, there are instances in which a court will nevertheless decide against enforcing an arbitration provision. The Supreme Court of Montana recently held in the context of a construction dispute that a party can waive its right to compel arbitration by not enforcing that right in a timely manner. -
